Two weeks ago ,I slipped on ice outside my door , I live in a handicap , elderly complex ..I spoke to my insurance rep , and he thinks that ,the buildings insurance company should pay me for pain and suffering ..As all my medical is paid by state medicaid ..
It is the buildings responsibility to remove the ice and snow , and it really has not been done well since before christmas ..Anyway the insurance investigator called we discussed things , and I sent her pictures for proof .I have been in pain ever since , and I think I may have a fracture in my hip , as i cannot sit on hard seats without pain ..I may have to go through some physical therapy , and the fall has made other medical conditions worse ..Not to mention the fact , that I hit my head hard , and am now having strange headaches ..So how much do I ask for in a settlement ..I told my mother I wanted like 5 or 6,000 , she thought that was no where near enough..Please give me an idea ..

so what pain and suffering have you had? here’s a clue, if you had a fractured hip you would not be walking around. keep in mind that you will need documentation for any suit. the only pain and suffering you describe here is the pain of indecision over how much money you should get.

I think we all have some kind of responsibility to watch where the hell we are walking. I do think the complex should have had the sidewalk cleaned in your case, but still I think there are way to many ridiculous law suits and that is a small part of why this country/economy is going to hell in a hand bucket!

Get a lawyer and do not settle with any insurance company. You want them cover past, present, and future medical bills and pain and suffering. If you settle with an insurance company they will stiff you! Be careful! Let the lawyer do the negotiating for you.
