You are way better off with an attorney also because you will have further sufferings. $12800 is nothing.
If you need, this is a free service http://locate-power-of-attorney.info/
you’ll have to pay later but you can choose the cheapest of the quotes or you can choose to do nothing, meaning there’s no obligation to go ahead with anything.

It’s really up to you. If the guy’s insurance company is willing to pay all of your medical expenses and damages for your car, get it in writing but with the amount of damages to your car and your body, it probably would not be a bad idea to consult an attorney and get some advice.

The amount paid for pain and suffering is determined by the amount of damage to the vehicle and the severity of the injuries. Try negotiating with the insurance company. If you obtain an atty, a percentage of your settlement will go to them. Good luck and hope you feel better soon!

You’d probably be better off hiring an attorney.
Granted, he’ll take one-third of any settlement or award you receive, but consider this: with his help, that amount would likely be greater than anything you could have negotiated on your own.
Speaking from experience, be prepared to wait, though.
In March 2005, I slipped and fell and broke my left arm, putting me out of work for about three or so months. I consulted an attorney regarding this, and only recently – this past September – was my case finally concluded, four and a half years later.
Part of the delay was the nature of the case, given what must be done, such as research, investigation, filings, motions and so forth. The other was that the defendant – my now-former employer – put in obstacles to delay my case, in the hopes that I would tire of their efforts and let the matter drop.
In any event, get well soon.
