I was hit by a drunk driver last Christmas, and at the time felt no pain. Later that night, I went to the ER with knee pain, had x-rays, and was given a knee brace. I was referred to an orthopedic surgeon and had an MRI done on my knee, and he told me to go to physical therapy. The only problem was that I couldn’t go immediately since I had no car to drive and nobody to take me (it took weeks to get a car, and my parents had to work). I went back to school in mid January, (I’m a college student), and continued to have knee pain. Over spring break, I finally went to a physical therapist. I was in physical therapy until the last week of May, and was discharged. I felt fine the rest of the summer. Now school has started up, and although I’m walking a lot, I actually think I’m less busy/physically active than I was this summer. My knee is absolutely killing me with the same type of pain, and I don’t understand. Should I go back to physical therapy, or what action should I take?

I was in an accident a few weeks ago and the seat belt caused some pain in my abdomen. Could this have caused an external hemorrhoid to form? Maybe the medication made B M harder to do? I also had to go to physical therapy, could that have brought it out?
This is the situation that has happened to a neighbor of mine: the man was in a auto accident where the other driver admits full responsibility and has full coverage. The injured party has large and serious bruising on his knee and his foot and ankle as a result. He goes to his PCP who refers him to a orthopoedic surgeon who takes x-rays of the ankle and the knee… he finds no fracture but he wants the man to have physical rehab for the ankle.
My question is does the auto insurance of the reponsible party only pay for the medical procedures… or would they also consider pain and suffering? And is that a given?
This neighbor is a 50 year old man who had a stroke many years ago and is currently unemployed… he is also on coumadin (a blood thinner that no doubt contributed to his severe bruising… of course he has the right to drive and is not impaired). He is not the brightest bulb and I want him to be fairly compensated….. he’s a good guy and I am afraid that he might be taken advantage of.
Also, is “pain and suffering” amounts (if it would be warranted) based on a scale of how much the medical procedures cost? In other words, if the medical bills totalled $1000 would he expect 2 or 3 times more than that?
I would really appreciate any answers from anywhere who knows about this type of law… thank you.
I am a middle age woman, was in an accident last year and absolutely can not even do the things I use to do. I can’t even go shopping for 45 minutes without being in pain. Yes we have gone to a lawyer, and I was offered one settlement, told the lawyer to tell them NO. Now I have went back to the doctor and my back is messed up either to the point where physical therapy is my best and temporary means and the worst case scenerio is back surgery which I do not want at all. How do you put a price on the suffering to make a settlement?
I have never had back problems and after a tiny auto accident I now have low to moderate pain and at times severe. They did an x-ray and say I have massive inflamation, ok then they do an MRI and now I am hearing that it appears that I have degeneration of the spine. Ok so now what? I have filed this on my auto insurance since I had no prior pain in my back till the accident. I am going through physical therapy 3 times a week. I am just scared this is going to get ugly with the insurance companys. auto/health. Any advice I would love to hear it.
When the car insurance company decides to give you a settlement from a bad car crash that you were a passanger in.. what kind of things decide how much money they will give you or if at all? My neck and back were injured and I have headaches everyday. I’m currently in physical therapy.
What can I expect in the future as far as pain and money?
Last August I was in a freak accident while boarding at the ocean. Along with breaking my face, I also got severe whiplash in my neck and lower back. I had physical therapy for a while and when the pain in my muscles went mostly away, I stopped. There are two places if I touch in my back and lower back directly on my spine that pinch terribly and radiate pain through my legs and back-which usually results in an instant migraine. Could this pain be only from the trauma, or something more serious? I cannot walk around for more than two hours without having to lay down-(sitting is also painful)
I’m asking this question on here, because my back specialist 100% disregarded me because he believes that nothing should be wrong in someone my age. Horrible doctor-yes I plan on getting a new one.
I did not get an MRI when I went to the hospital because they were more concerned about the blood i was losing from my head.

What Should Be The Minimum Amount That I Settle For My Automobile Accident With A Torn Rotator Cuff?

In October 2005, I was at a complete stop and was rear-ended by a 15 year old who was going at least 40 mph. I suffered from whiplash and a torn rotator cuff. I went through physical therapy for about 7 weeks which did not help. I had to have surgery in May 2006 and 8 additional weeks of therapy. Even now, I am still in pain. My Orthopedic surgeon believes I have not healed because of some type of autoimmune issue (non diagnosed arthritis ). So I was referred to a Rheumatologist who believes that I have reactive arthritis. She believes that the surgery caused a “flare up.”
I have never had an issue with shoulder pain before the accident. How would the claim department view this case? Would they reduce my claim because they felt I had a pre-existing medical condition? The sum of my medical bills so far is about $19,500, my car had $3300 damage and I had $2000 lost wages. I have a lawyer and I am required to pay my health insurance once I receive my settlement.
Car Accident Back Pain?

Is it true that after being involved in an auto accident that back pain can linger long after completed therapies…that I could be dealing with some form of discomfort from muscle spasms my entire life?…I finished my chiro care and am going into physical therapy it got better but after i finished with the chiropractor the pain came back…is back pain that hard to get rid of? The accident was not that major but it was enough to cause muscle spasms in my neck and back.
I am more inconvenienced by the time it takes to go to the doctor’s office, getting auto estimates, trips to physical therapy, and looking around for medical supplies for my pain. I could have used this time to be with family, work on my business, or teach adjunct at a local college. How do I quantify this ($) when making a claim? I am on summer break (teacher) so it did not affect wages.
